Peloton Interactive, Inc. secured a voluntary surrender of Echelon Fitness LLC’s registration of the service mark “NEVER RIDE ALONE” that was the subject of a proceeding before the U.S. Trademark Trial and Appeal Board.
On January 15, 2020, Peloton filed a petition for cancellation of Registration No. 5,721,525 for the service mark “NEVER RIDE ALONE” in the United States Patent and Trademark Office, Cancellation No. 92073303. In the petition for cancellation, Peloton alleged that it began using the “Never Ride Alone” mark in late 2013 in connection with its revolutionary interactive stationary bike, and that Echelon and its parent company nevertheless filed to register trademark protection for an identical slogan in August 2018. Peloton argued that Echelon’s registration was obtained in part through knowing and intentional misrepresentations.
Rather than fight for continued registration, Echelon filed a voluntary surrender of trademark registration.
This is just the latest in the string of many intellectual property victories that Hueston Hennigan has achieved for Peloton.
